♓The Allahabad High Court has granted transit anticipatory bail to Sushil Singhania, the uncle of the estranged wife of the deceased, Atul Subhash. The court’s decision, announced on Monday, offers temporary relief to Singhania, who was one of the individuals accused of abetting Subhash’s suicide.
ꦡSushil Singhania, along with other in-laws of Atul Subhash, had been named in an FIR filed in Bengaluru. The FIR charges them with abetment of suicide and criminal conspiracy, following the tragic death of 34-year-old Subhash, a software engineer, who committed suicide. Subhash left behind a chilling suicide note and a video in which he accused his wife, Nikita, and her family of harassment, which, according to him, drove him to take the extreme step.
🦩The family’s ongoing legal battle over divorce, alimony, and child custody, centered in Jaunpur, Uttar Pradesh, forms the backdrop of the allegations. In his video, Subhash accused his wife and her family of pressuring him with multiple legal cases and false accusations.
🅺On December 13, an anticipatory bail application was filed by Nikita Singhania, her mother Nisha, her brother Anurag, and her uncle Sushil, in the Allahabad High Court. However, the court observed that since Nikita, Nisha, and Anurag had already been arrested by Bengaluru police on Sunday and remanded to judicial custody for 14 days, their application for transit anticipatory bail had become irrelevant. Therefore, the hearing proceeded only for Sushil Singhania’s case.
📖The court examined the evidence, including Subhash's suicide note, and noted that the primary accusations of instigating the suicide were directed at several individuals, including Nikita Singhania, her mother-in-law Nisha Singhania, and the Principal Judge of the Family Court in Jaunpur, Reeta Kaushik. ꦰDefense counsel argued that Sushil, a 69-year-old man with multiple chronic health conditions, could not be accused of abetting Subhash’s suicide. It was further contended that the case, even if the suicide note was taken at face value, could only suggest harassment related to false legal cases and financial demands, not abetment to suicide.
Considering these factors, Justice Ashutosh Srivastava of the Allahabad High Court ཧgranted Sushil Singhania's request for transit anticipatory bail. The court imposed a set of conditions, including the requirement for Sushil to furnish a bail bond of Rs 50,000 along with two sureties.
